1. Acceptance of Terms

Welcome to Fasly. By accessing or using our website, mobile applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms apply to all users of the Services, including schools, administrators, teachers, parents/guardians, and students. Material updates may require re-acceptance in the product.

2. Description of Services

Fasly is a software platform for Hifdh and Maktab program management. We provide tools that enable:

  • Schools to manage Quran education programs, classrooms, and registrations
  • Teachers to assign lessons, track progress, and grade student recitations
  • Parents/guardians to monitor their children's learning progress
  • Administrators to oversee institutional operations and billing

Fasly provides software only. Each school runs its own educational program and is responsible for its staff, on-site supervision, curriculum decisions, discipline, and communications with families.

3. Roles and Responsibilities

3.1 Fasly

We operate and maintain the Services, process data on behalf of schools as described in our Privacy Policy, and provide customer support for the software.

3.2 Schools and administrators

When you create or administer a school account, you represent that you have authority to bind that school. You are responsible for:

  • Managing user access within your organization
  • Ensuring appropriate use of the Services by staff and families
  • Obtaining lawful parental/guardian consents for student data
  • The accuracy of information entered into the Services
  • Your school's parent handbook / School Policy content (see Section 4)

3.3 Teachers, parents, and students

Teachers and parents use the Services under their school's account. Student accounts for minors are created and managed by schools or guardians; guardians are responsible for supervising a minor's use where applicable.

4. School Policies

Schools may publish a School Policy (parent handbook) through the Services for guardians to review and accept during registration or when the policy is updated. That document is authored and controlled by the school. Fasly hosts it as a convenience and is not a party to the school–parent relationship, enrollment rules, fees, or discipline decisions described in a School Policy. Disputes about school rules must be resolved with the school.

5. Account Registration

5.1 Account creation

To use certain features, you must register for an account. You agree to provide accurate information, keep credentials secure, and accept responsibility for activity under your account.

5.2 Minors

The Services are intended for use by schools and adults (administrators, teachers, and parents/guardians). Children's educational records are entered by schools or guardians. We do not knowingly allow children to create independent accounts without school or guardian involvement.

6. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates applicable laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services to transmit harmful code or malware
  • Collect or harvest user information without authorization
  • Use the Services for any commercial purpose not expressly permitted
  • Upload unlawful, harassing, or infringing content

7. User Content

7.1 Ownership

You retain ownership of content you submit. By submitting content, you grant us a license to use, store, and display it as necessary to provide the Services.

7.2 Responsibility

You are solely responsible for content you submit and represent that you have the right to submit it and that it does not violate third-party rights.

8. Student Data

For student and guardian data entered by a school, the school typically determines the purposes of processing (acting as the organization responsible for that data), and Fasly processes that data to provide the Services on the school's instructions. See our Privacy Policy for details. Schools must have a lawful basis (including parental consent where required) to enter children's information into the Services.

9. Intellectual Property

The Services, including features and branding, are owned by Fasly and protected by intellectual property laws. You may not copy, modify, or distribute the Services without permission, use our trademarks without authorization, reverse engineer the software, or remove proprietary notices.

10. Privacy

Our Privacy Policy describes how we collect, use, and protect personal information. By using the Services, you also agree to that policy.

11. Fees and Payment

Certain features require a paid subscription. If you use paid features:

  • You agree to pay applicable fees described at purchase or in your plan
  • Fees are non-refundable unless otherwise stated or required by law
  • We may change pricing with reasonable notice
  • Failure to pay may result in suspension or termination of Services

School tuition, book fees, and other amounts charged by a school to families are between the school and the family; Fasly is not the merchant for those charges unless expressly stated.

12. Termination

We may suspend or terminate access for breach of these Terms or to protect the Services. You may stop using the Services and request account closure by contacting us. Provisions that should survive (including liability limits, indemnity, and ownership) survive termination.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE OPERATION.

We do not guarantee educational outcomes. On-site duty of care, supervision, and instructional quality remain with the school and its staff.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICES.

15. Indemnification

You agree to indemnify and hold harmless Fasly and its officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the Services; your violation of these Terms; content you submit (including School Policy text); enrollment, fee, or discipline disputes involving your school; or student/guardian data you collect or enter without proper authority or consent.

16. Changes to Terms

We may modify these Terms. We will update the version and "Last updated" date on this page. For material changes, we may require re-acceptance in the product. Continued use after changes become effective constitutes acceptance where permitted by law.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts in Ontario shall have exclusive jurisdiction, subject to mandatory consumer protections that cannot be waived.
